In regard to the following scenario, assume you are the in-house legal counsel and list five (5) things that you would advise the Chief Executive officer to do or to look into further to address the situations described. It’s a typical Monday for Ms. Jones, the CEO of Cure All Hospital. She starts the day by attending an early morning medical staff meeting at which the physicians demanded to be paid for on-call services provided to the Hospital. Some of the physicians are employed by the Hospital and others are not. They are not all in the same specialty and the number of physicians in each department varies. The physicians demanded to be paid or they will band together and refuse to perform surgeries at the Hospital. Upon arriving back at her office, Ms. Jones is greeted by a very upset IT Director who indicates that there is evidence that the Hospital’s electronic medical record system has been hacked. The IT Director informs the CEO that he has contacted a software consultant to help apply security patches, but is wondering if there is anything else that should be done. Ms. Jones eats lunch with the Director of Nursing who indicates that due to a nursing shortage, she needs the nurses to stay on-campus to eat lunch in order to be available in case of emergencies. The DON also informed Ms. Jones that some medications have been determined to be missing and wonders what needs to be done. Later in the afternoon, Ms. Jones is reviewing the Hospital’s financial and patient volume information and considering the impact of the Affordable Care Act on the Hospital’s finances. Ms. Jones would like to consider financial arrangements with physicians that will increase patient volume and revenue for the Hospital. As the day winds down, Ms. Jones receives a call from the Chief Operating Officer who notifies Ms. Jones that she has been notified by the Department of Health that they will be out to survey the Hospital in the next week or two. The COO wants to know if there is anything that should be done to prepare for the survey.
